Workforce Training and Development and Incentives
North Dakota's economy is robust, many businesses are opening and expanding, the unemployment rate is low, and the labor force participation rate is high. However, the quantity and quality of the workforce is not available to support this increasing demand. To assist businesses in creating and maintaining both quantity and quality in North Dakota's workforce, the following programs and incentives have been established:

•Operation Intern provides matching funds to support the expansion of internships and work experience opportunities with North Dakota employers in target industries and within the Federal Executive Branch for postsecondary students enrolled in a course of study at a North Dakota school.

•Workforce Training is the process of providing the best, most up-to-date training to employees, making them more competitive in the workforce and more valuable to an employer. In 1999, the North Dakota legislature created the Workforce Training Initiative on a statewide level and made it a top priority. They recognized that for North Dakota to remain viable and competitive, major changes were urgently needed for business, industry, and individual communities. The Workforce Training Initiative was created to solve the problems faced by businesses, which include hiring and maintaining a well-trained workforce.

•Workforce 20/20 provides funding assistance to businesses to offset training costs for current workers and new employees when the business is new to the state, expanding employment in the state, introducing new technologies or introducing new production methods designed to fill gaps left by federally funded training programs that generally target long term-unemployed, dislocated workers, and other disadvantaged groups.

•Internship Tax Credit is an individual, estate, trust, partnership, corporation, or limited liability company is allowed an income tax credit for employing an individual under an internship program located in North Dakota. The credit is equal to 10% of the compensation paid to an intern. The compensation paid to up to five interns is eligible for the credit. An employer is allowed a maximum of $3,000 of credits for all taxable years combined.

Work Opportunity Tax Credit

The Small Business and Work Opportunity Ace of 2007 extends the WOTC Program through August 31, 2011. The WOTC has two purposes:
• To promote the hiring of individuals who qualify as a member of a target group; • To provide a federal tax credit to employers who hire individuals.
An employer may qualify for a tax credit of up to $9,000 if the employee is a member of a designated target group and meets that group's specific requirements.
Target Groups the Qualify for the WOTC - Individuals hired from the following nine target groups may qualify an employer for the WOTC:
A. Qualified recipients of Temporary Assistance to Needy Families (TANF).
B. Qualified veterans receiving Food Stamps or qualified veterans with a service connected disability who: • Have a hiring date which is not more than one year after having been discharged or released from active duty OR; • Have aggregate periods of unemployment during the one year period ending on the hiring date that equal or exceed six months.
C. Ex-felons hired no later than one year after conviction or release from prison.
D. Designated Community Resident - an individual who has attained ages 18 but not 40 on the hiring date who reside in an "Empowerment Zone Renewal Community, or Rural Renewal County.
E. Vocational rehabilitation referrals, including Ticket Holders with an individual work plan developed and implemented by an Employment Network.
F. Qualified summer youth ages 16 through 17 who reside in an Empowerment Zone, Enterprise Community, or Renewal Community.
G. Qualified Food Stamp recipients ages 18 but not 40 on the hiring date.
H. Qualified recipients of Supplemental Security Income (SSI).
I. Long-term family assistance recipients.
*Federally Designated Communities include Empowerment Zones (EZ), Enterprise Communities (EC), Renewal Communities (RC), or Rural Renewal Counties (RRC) (for hires after May 25, 2007.
Requirement: Prospective employee must complete and submit IRS Form 8850 (www.irs.gov/) by the date of a job offer. Form must be signed by the employer. Then employer must fill out one of two forms: ETA Form 9061 (fill out if the new hire has not been given a conditional certification) or ETA Form 9062 (fill out if the new hire has been issued a conditional certification by participating agency.

Work Opportunity Tax Credit (link)
• Workforce Recruitment Credit is an individual, estate, trust, partnership, corporation, or limited liability company is allowed an income tax credit for employing extraordinary recruitment methods to recruit and hire employees for hard-to-fill positions in North Dakota. The credit is equal to 5% of the compensation paid during the first 12 consecutive months to an employee hired to fill a hard-to-fill employment position, and is allowed in the first year following the year in which the employee completes the 12 consecutive month employment period. An unused credit may be carried forward up to four years. In the case of a passthrough entity, such as a partnership or S corporation, the credit is passed through to its owners in proportion to their ownership interests.

• North Dakota New Jobs Training Program provides incentives to businesses that are creating new employment opportunities through business expansion and relocation to the state. The program provides primary sector businesses with no-cost funding to help offset the cost of training new employees. The North Dakota New Jobs Training Program provides for the capture of the state income tax withholding generated from the new job positions that are created.

•Student Loan Forgiveness for Public Charity Employees The College Cost Reduction and Access Act includes a provision allowing the secretary of Education to forgive the balance of federal student loans held by public service employees who (a) have not defaulted on their loans, (b) have made monthly payments on their loans for 120 consecutive months after October 1, 2007, and (c) were employed full-time in a public service job during the entire 120 months during which they made the payments. The law includes employment "at an organization that is described in section 501(c)(3) of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code" ( i.e., a public charity) in the definition of "public service job."
